These terms and conditions govern your use of the Picture Frames Buddy website, and any contract entered into between you (the customer) and us (Picture Frames Buddy or the company). By using the website, you signify your agreement to these terms and conditions. If you do not agree with them, you should discontinue use of the website. You must agree to these terms and conditions prior to submitting an order.

Price

Price matching

While we cannot guarantee to price match a competitor’s product, which in our opinion is inferior or unreasonably priced as a ‘loss leader,’ we do monitor our competitors online, and will endeavour to offer a balance between quality and value. If you find what you believe to be a comparable product at a lower price, please contact us with the details and we will consider it.

Pricing

  1. Prices on this site include VAT.
  2. The price excludes delivery, unless otherwise stated.

Cancellation

In accordance with UK Distance Selling laws, if you need to cancel an order prior to manufacture or despatch, you may do so by contacting us quoting your order number and reason for cancellation. However, the way in which we handle your request will depend on several factors.

  1. If you cancel an order before it has been processed, we will cancel the order and refund any monies paid to us in the same way they were paid, minus any processing fees we incur.
  2. If the order is for a standard product which has already been processed and despatched, you will not be able to cancel the order (even if this is with the 7 day ‘cooling off period’) but you will be able to return the products to us through our returns procedure for a full refund. You may incur costs in returning the goods, however.
  3. If you have ordered personalised or custom manufactured products and these have been made for you (even if they have not yet been despatched) we regret we are unable to cancel or refund the order, as these items are unsalable to other customers.

Additionally, if we fail to deliver your order within a reasonable time and have not contacted you to discuss any issues, you may cancel the order. We may also refuse or cancel an order if payment is not received.

Please Note: If you request a cancellation, your order is not cancelled until you receive written confirmation of the cancellation from us.

Payment

  1. You must pay for your order when placing it through the Picture Frames Buddy website. If you use an alternative ordering method (such as via email, telephone or personal contact with one of our representatives) we must still receive payment in advance or processing or manufacturing all orders.
  2. If your payment fails to complete, your order will not be processed.
  3. Payment must be made in Pounds Sterling.

Specifications

Because we work with natural materials, we cannot guarantee each batch will have the exact same colour as previous batches, and we work with a tolerance for sizing to make fitting pictures and glazing into frames easier. Because of this, if you have previously bought products from us, you may find that repeat orders are from a different batch and do not match exactly. If you need a large quantity of products and need them to match, contact us prior to ordering.

Also, due to the limitations of digital technology, the product you receive may not exactly match the colour and tone of the digital image used to represent it on the website.

  1. Tone & shade of product may vary slightly to that displayed digitally
  2. Tone & shade of product may vary slightly between orders
  3. Picture frame material will be accurate to within 8mm
  4. Picture frame sizing ( internal ) will be accurate to within + 6mm to allow for the safe / easy removal of picture frame Glazing & picture frame backing.
  5. Picture Mount sizing ( external ) will be accurate to within +/- 2mm
  6. Picture Mount sizing ( internal ) will be accurate to within +/- 2mm

Delivery

We aim to manufacture all orders within 3 working days of receipt of payment. If you need a faster turnaround, particularly on custom or personalised goods, please contact us to discuss your requirements prior to ordering.

All orders are delivered through our courier, who will contact you by text if you have provided a mobile number when your delivery is scheduled. At this point, you may contact the courier direct to rearrange delivery.

  1. Delivery times are estimates from manufacture.
  2. If we fail to deliver within a reasonable time you may cancel the contract.
    1. If the contract is cancelled you have no claim against us for delay, costs incurred or if the goods have been despatched before the contract is cancelled.
  3. We may deliver the goods in instalments
  4. The goods are at your risk from the time of delivery
    1. Deliveries take place either
      1. At our premises (if you are arranging collection)
      2. At your premises (if we are arranging delivery)

Title

Title in the goods passes to the customer at time of despatch provided payment has been received in full. This does not affect your statutory rights.

Refund, exchange and return

Although we take great care and pride in our work, and go to great lengths to make sure your products are manufactured to your specifications, carefully packaged and boxed for delivery, and as ordered, we know mistakes occur from time to time and products are occasionally damaged in transit despite our best efforts.

Our refund, exchange and return policy ( below ) is in strict accordance with the latest UK government distance selling regulations / guidelines:

  1. If you have received goods which are defective in material and or workmanship you must
    1. Inform us within two days of signature of goods and allow us the time to re-collect the goods, inspect the goods & replace the goods
    2. If you have received goods which are not the goods placed on your order you must inform us within two days of signature of goods and allow us the time to re-collect the goods, inspect the goods & replace the goods.
  2. Where goods are manufactured to order / personalised, we do not offer refund or accept return on correctly supplied undamaged products.
    1. Standard products which we may be able to restock may be returned to us within 7 days at your expense in the original packaging, if we then deem the items to be in perfect condition and ready for re-sale, we will refund the cost of the item(s) back onto the payment method within 30 days.
  3. If goods are returned because they are thought to be not of satisfactory standard in opinion but we the Manufacturer believe the goods to be of a satisfactory standard we reserve the right to refund only part of the amount paid to cover our expenses such as postage, re-collection, manufacture and re-manufacture ( if applicable )
  4. We do not accept returns unless agreed and/ or arranged by us.
    1. In the event of goods being returned without our written consent, the goods will be held in their returned condition in despatch for a period of 4 weeks, when this 4-week period expires the goods will be disposed of.

General

  1. English law is applicable to any contract made under these terms. The English and welsh courts have nonexclusive jurisdiction
  2. If you are more than one person each of you has joint and several obligations under these terms
  3. If any of these terms are unenforceable as drafted it will not affect the enforceability of any other than these terms and at will be treated as so amended
  4. No contract will create any right enforceable (by virtue of the contract act) act 1999 by any person not identified as the buyer or the seller
  5. The only statements upon which you may rely in making the contract with us are those made in writing by someone who is (or whom you reasonably believe to be) our authorised seller, agent or sales person by
    1. Contained in our estimates (or any covering letter) and not withdrawn before the contract is made or
    2. Which expressively states that you may rely on them when entering into the contract
    3. Nothing in these terms affects or limits our liability for fraudulent misinterpretation.
  6. You may not copy any content contained within this entire website without the written consent of Picture Frames Buddy
  7. When making a purchase you will be agreeing to our terms & conditions. You may be notified of future Picture Frames Buddy news and offers. If you would like to unsubscribe from this simply email your request to admin@pictureframesbuddy.co.uk. There will also be an unsubscribe option on any emails that we send to you.

Privacy

We are committed to protecting your privacy and security when using our website. We will protect your data as if it were out own, using the most up to date technology. We will not share it with third parties unless required to do so by law, or (as in the case of our courier) to fulfil your order.

We do not store, have access to or collect any payment / sensitive information. We do store order information for administrative purpose only.
